Humanitarian and Compassionate applications, often referred to as H and C, provide an
immigration pathway for individuals who may not qualify through traditional programs but
have compelling reasons to remain in Canada.
These applications are considered on a case-by-case basis and are highly discretionary. Officers review factors such as the best interests of children, establishment in Canada, and
potential hardships if the applicant were required to leave. For example, someone who has lived in Canada for many years, built strong community ties, and has children integrated into Canadian schools may be considered under H and C grounds.
It is important to note that H and C applications are not a substitute for refugee claims or
other programs. They are intended for exceptional circumstances and must be supported
with strong evidence. Letters of support, proof of community involvement, and
documentation of hardship in the country of origin are commonly included.
Processing times can be lengthy, and there is no guarantee of approval. Applicants must be
realistic about the challenges and prepare thoroughly.
Despite these challenges, H and C applications provide a lifeline for those who have no other avenue to remain in Canada. They reflect Canada’s commitment to compassion and fairness within its immigration system.
