Has your Temporary Resident Status Expired? Did you know you still may be able to extend your stay based on a temporary public policy issued by IRCC?
Update from Immigration, Refugees and Citizenship Canada Earlier this year, IRCC announced another new temporary policy that will allow individuals who have fallen out of status to restore their status even if they have been out of status for more than 90 days Restoration of Status
Restoration of Status means that you may apply to remain in Canada even if your status had previously expired and you are currently out of status in Canada.
Normally, if a temporary resident falls out of status they have 90 days to apply for restoration of their status in Canada. Temporary residents include students, workers, and visitors who are in Canada on a temporary basis.
In 2020 the government of Canada announced a public policy that would allow restoration beyond 90 days, until December 31, 2020.
Recently, this public policy was extended and individuals now have until August 31, 2021, to restore status if they continue to be out of status. In addition, the eligibility criteria were expanded to include foreign nationals who were in Canada from January 30, 2020, to May 31, 2021.
This public policy came into effect on July 14, 2020, and will remain in place until August 31, 2021. If you have fallen out of status please contact us so that we can help you to get back in status as soon as possible. Despite the extension, it is always better to remain in status and to demonstrate an effort to remain in status.
